Medical malpractice is the failure of a doctor, nurse, medical technicians or other health care provider to meet the standard of care for their medical field. Medical malpractice occurs when a health care provider fails to properly treat a medical condition and the negligent act or omission is the cause of a new or aggravated injury to the patient. In cases where a patient has been treated by multiple professionals, determining fault may be difficult because some times multiple professionals may be liable. Some common medical mistakes may include:

In many medical malpractice cases, proof of negligence is found in these records. In order to determine if there is "medical malpractice" it is necessary that a medical expert be retained in order to give a medical opinion of the claim. If after a thorough review of the pertinent medical records, the medical expert concludes "with reasonable medical certainty that the action or inaction of the defendant physician was the cause of damage to the plaintiff," then it will have to be determined if suit should be filed against the negligent health care provider.
