Personal Injury

Personal Injury law seeks to protect people who are injured by the wrongful or negligent actions of others.

Defining Domestic Violence

Physical abuse is not the only type of domestic violence. In many cases it is the emotional abuse that goes unreported – and often unrecognized. While the effects can be equally devastating, many victims do not know where to turn for help or who to trust. Fortunately, there is legal help for victims of physical, sexual or mental abuse. The key is to recognize the signs of domestic violence and take the necessary steps to break the cycle.

Dog Bite Victim

Being attacked by a dog can cause severe wounds. It is one of the worst ways in which a person can suffer severe injuries.  You may not know this, but last year more than 800,000 people in the United States were attacked by dogs, and unfortunately a lot of these victims were children.  Because of their size, children are the ones who suffer the most serious injuries since the animal can easily reach for their face, neck, or head -- often leaving them scarred for life.

What is a wrongful death?

A wrongful death is a death that was caused through the fault of another person. Both individuals and companies can be found liable in wrongful death cases. The most common cases of wrongful death are:

  • Traffic or boating accidents
  • Defective products
  • Nursing home neglect

Typically speaking, a wrongful death case will attempt to determine the amount of income the deceased person would have earned in their lifetime to figure out monetary damages. Other monetary compensation may also be awarded for things such as medical bills, legal fees, burial costs or emotional pain.

What is medical negligence?

Medical negligence is when a person employed by the healthcare industry injures a person while providing medical attention. The tricky part is that in order to prove medical negligence it’s necessary to show that another medical professional would not have made the same mistake in that scenario.

Speaking Spanish at Work

If your company can prove that it is necessary for you to only speak English for the good of the job, they can require that you not speak Spanish. There are many jobs where speaking English is required. Unfortunately, this type of rule makes it difficult for many Hispanic workers to find and keep a job. This situation is very frustrating for many people since learning a new language is a terrible burden on top of coming to a new country and establishing a home within your community.

Don’t Be Afraid to File a Worker’s Compensation Claim

If you’re injured at work, it’s important that you not be afraid of filing for a worker’s compensation claim. By law your right to do so is protected, regardless of your immigration status. Many workers in Florida fear that filing for a worker’s compensation claim will cost them their jobs, even though the law was made for the protection of everybody. Often a lack of understanding of the worker’s compensation process convinces injured workers that they would be better off hiding their injuries.
