Misrepresentation describes a situation where a misstatement causes monetary loss, rather then harm to a person.

Two (2) types of Misrepresentation:

  1. Intentional Misrepresentation:this deals with deceit or fraud. The victim must show:
    • False representation by the wrongdoer;
    • Of a material fact;
    • Made with malice or known by the wrongdoer to be false;
    • Which induces the victim to rely on the misrepresentation;Resuling in a money loss to the victim where they can recover out of pocket and benfit of the bargain.
  2. Negligent Misrepresentation: this occurs when one who in the course of their profession or employment, or in a transaction in which there is a monetary interest, makes a false statement to another for their guidance in a business transactionis liable for the other’s monetary loss through their justifiable reliance.
